Terms and Conditions

1. Information on how to enter the Promotion forms part of these Terms and Conditions. Entries not made in accordance with these Terms and Conditions will be disqualified.
2. The Promotion commences at 12.00 am on 1 October 2011 and closes at 11.59 pm on 9 September 2012 (“Promotion Period”). All times recorded throughout these Terms and Conditions are in Australian Eastern Standard Time. The Promoter is Club Marine Limited of 40 The Esplanade, Brighton Victoria 3186, phone 1300 00 2582, ABN 12 007 588 347.
3. Entry into the competition is only open to Australian and New Zealand residents aged 18 years or over who have a current Club Marine magazine subscription during the Promotion Period. Employees of the Promoters and their immediate families, participating agents and their agencies associated with this Promotion are ineligible to enter the competition. The Promoter reserves the right to verify the validity of each entry and to disqualify any person for tampering with the entry process. Further, any contact details provided incorrectly may be deemed by the Promoter as an invalid entry.
4. Entry into the competition is automatic when an entrant is a current Club Marine magazine subscriber during the Promotion Period. The subscription will be valid when purchased and Club Marine receives payment in full. There is only one (1) entry made per subscription.
5. A subscription to Club Marine magazine can be taken out by either renewing their subscription with their Club Marine Insurance Renewal, subscribing online to the magazine (www.clubmarine.com.au) or sending in a subscription form that can be downloaded from the Club Marine website (www.clubmarine.com.au) and sending to Club Marine 40 The Esplanade Brighton 3186 with a payment by cheque or credit card.
6. A representative of the Promoter will conduct a random draw of all entries. There will be one (1) major prize and two (2) runner-up prizes awarded every second month during the Promotion Period. The first valid entry drawn will be the winner of the major prize. The next two (2) valid entries drawn will each be the winner of a runner-up prize per issue. The prize winner will be electronically selected at random from a computer-generated listing of entries submitted over the Promotion Period. The draw will take place:
   
   
   1. The first draw will take place at 3.00pm 7 November 2011 at Club Marine Limited of 40 The Esplanade, Brighton VIC 3186.
   2. The second draw will take place at 3.00pm 9 January 2012 at Club Marine Limited of 40 The Esplanade, Brighton VIC 3186.
   3. The third draw will take place at 3.00pm 5 March 2012 at Club Marine Limited of 40 The Esplanade, Brighton VIC 3186.
   4. The fourth draw will take place at 3.00pm 7 May 2012 at Club Marine Limited of 40 The Esplanade, Brighton VIC 3186.
   5. The fifth draw will take place at 3.00pm 9 July 2012 at Club Marine Limited of 40 The Esplanade, Brighton VIC 3186.
   6. The sixth draw will take place at 3.00pm 10 September 2012 at Club Marine Limited of 40 The Esplanade, Brighton VIC 3186.
7. The Prize Winners will be notified by writing and telephone of their win and how to claim the prize within 24 hours of the draw. Their name will be published in The Australian newspaper within seven (7) days of the draw. 1^st draw winner to be published in The Australian on 14 November 2011, 2^nd draw winner to be published in The Australian on 16 January 2012, 3^rd draw winner to be published in The Australian on 12 March 2012, 4^th draw winner to be published in The Australian on 14 May 2012, 5^th draw winner to be published in The Australian on 16 July 2012 and 6^th draw winner to be published in The Australian on 17 September 2012.
8. The prizes are as follows:
   1. The six (6) Ultimate Boating major prize experiences for two adults including flights from the winners closest major capital city drawn each issue of the magazine (bi monthly) are valued at a total amount of AUD$67,656.00 and valid for travel up to 12 months from the date of the draw specified in clause 4 subject to availability.
   1. Arnhemland Barramundi Nature Lodge – Fishing and Nature experience (1^st Draw)
      The winners will share a package at the multi-award-winning Arnhemland Barramundi Nature Lodge for 5 nights / 5 days fishing staying in a deluxe ensuite cabin. They will experience the unique natural environment of one of Australia’s true wilderness areas, as well as the excitement of fishing for one of the world’s iconic game fish. $14,150.00
   2. North Star Cruisers - Kimberley Cruising experience (2^nd Draw)
      A Kimberley Islands 6 night cruise aboard True North, one of the world’s finest adventure cruise ships. Winners will experience the spectacular wildlife and geography of the Kimberley, including the mighty Prince Regent River, the intriguing Montgomery Reef and the exhilarating Horizontal Waterfalls. $16,990.00
      
      
   3. Riviera Syndication – Queensland Coastal Cruise experience (3^rd Draw)
      A cruise with Riviera Syndication aboard one of the companies luxuriously appointed Riviera 5800 Sport Yachts. Winners will enjoy 5 days of being pampered while cruising the waters of the Queensland coast with a skipper and crew. $22,000.00
      
   4. Queensland Yacht Charters – Whitsunday Cruise experience (4^th Draw)
      Five days exploring the incredible Whitsunday Islands, one of the world’s premier cruising destinations aboard a fully-equipped charter boat from Queensland Yacht Charters. The winners will get to explore the many islands, reefs and beaches. $7,000.00
      
   5. Bulls Cruisers – Gippsland Lakes experience (5^th Draw)
      Winners will experience seven days exploring Victoria’s Gippsland Lakes with Bulls Cruisers. Four days on a fully-equipped charter boat cruising on Australia’s most beautiful protected waterways. Then transfer to the luxury of the Captain’s Cove resort for three night’s accommodation on the canals of Paynesville. $3,335.00
      
      
   6. Explore NZ – Auckland and Bay of Islands experience (6^th Draw)
      A five day Explore New Zealand adventure tour taking in Auckland’s scenic Hauraki Gulf and the world-famous Bay of Islands. Staying at one of Explore NZ’s preferred accommodation partners. Winners will swim with dolphins, see the spectacular Hole in the Rock and explore the coastline of one of the world’s finest cruising destinations. $4,181.00
   2. Two runner-up prizes per draw consists of a luggage package valued at AUD$459.95 each. The runner-up prize package contains:
      
      1x Club Marine overnight duffle bag, 1x Club Marine padded vest, 1x Club Marine short sleeve jersey polo, 1x Club Marine cap, 1x Club Marine shorts, 1x Club Marine socks and 1x pair of Tonic sunglasses
9. The total value of the prizes to be awarded during the Promotion Period is valued at AUD$73,175.40.
10. If a Prize Winner wishes to claim their Prize, the Prize Winner must acknowledge the prize within seven (7) days of the relevant draw. If the Prize Winner fails to do so by the deadline, that Prize Winner will be deemed to have forfeited the Prize.
11. Subject to any applicable law, in the event that any Prize Winner forfeits the Prize or a Prize/s remains unclaimed, the Promoter will conduct a single redraw, following the same procedure as the original draw until the Prize/s are awarded. The redraw will take place at 11am on 10 December 2012. The winner/s will be notified in writing and telephone. The winner/s will be published in The Australian on 17 December 2012 (subject to any further regulatory directions).
12. In the event that the prize is not available strictly as advertised and published through no fault of the Promoter, the Promoter reserves the right to offer an alternative prize of similar content and description, or offer the Prize Winner a payment equal to the value of the original prize as published and advertised subject to the regulative authority.
13. To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winner, releases the Promoters from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion. The Promoters, their related bodies corporate, officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential or economic loss) suffered or sustained in connection with this competition, the promotion of this competition, or the use of any prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoters exclude liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants’ or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
14. By entering this Promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of his/her information by the Promoters. For details about who we are, how we may use your information and what your rights are under the new privacy laws, please see the Promoters’ Privacy Policies, which are available from Club Marine Limited at (www.clubmarine.com.au) Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant, or distribution of marketing materials for goods or services in the finance and insurance industries from the Promoters or from companies in the finance and insurance industries in which the Promoters hold shares.
